The use of noncompetition agreements is on the rise and so is the amount of related litigation including trade secret protection and unfair competition claims. The enforceability of noncompete clauses varies from state to state. This poses quite a challenge both to employers operating nationally that want to secure contractual protections against unfair competition and to employers hiring within the industry. No company operating in this increasingly litigious and competitive environment can afford to remain uninformed on the new developments in the field.

This complimentary breakfast briefing is designed to give you the tools to protect your company's business in this challenging new environment. We will address the following topics:

  • New developments across the country
  • Creative new contract and policy approaches being used to address unfair competition and trade secret protection
  • How to draft effective agreements when hiring an employee or upon their departure
  • Litigation strategies to help you get the upper hand on offense or defense
  • Tips for conducting due dilligence and hiring safely from competitors
