2011 and Beyond—Navigating the Employee Benefits Minefield During Uncertain Legislative Times

The universe of people and workplace matters impacted by recent developments in employee benefits law has greatly expanded.

In recent years, laws regulating employee benefits and executive compensation have taken on extreme importance, not only in connection with employer-sponsored benefit plans and executive compensation arrangements, but also in relation to many employment-related agreements and programs. Laws such as the Patient Protection and Affordable Care Act, HIPAA, and Section 409A of the Internal Revenue Code have created enormous compliance challenges for employers, who must be cognizant of the laws' intricacies when entering into employment or severance agreements, crafting an incentive program, conducting a reduction in force or embarking on an employer wellness initiative. This legislative activity has created unprecedented complexity for benefit specialists in structuring benefits and compensation programs.

Additionally, the dockets of our courts have more benefits cases than ever, ranging from stock-drop claims, claims raising issues of ERISA preemption, and the fiduciary duty to disclose. In fact, the U.S. Supreme Court issued two important decisions in 2010, in Conkright and Hardt, and recently issued another important decision in 2011, in CIGNA Corp. v. Amara.

The Summit will provide an in-depth review of the most current and critical information regarding employee benefits and executive compensation during this time of legislative change, as well as the litigation hazards that frequently arise from both. It will take place over the course of a single day, Thursday, September 15, 2011, followed by a cocktail reception where guests will have the chance to network with peers, as well as Littler attorneys and guest speakers.
