Michael J. Lotito, a shareholder in Littler’s San Francisco office and co-chair of the WPI, has more than 35 years of experience advocating on behalf of employers, and is a nationally-recognized expert on legislative and regulatory matters affecting the workplace.
In addition to advising management in the U.S. and abroad on a variety of traditional labor and employment law issues, Mr. Lotito has on numerous occasions brought his expertise to Capitol Hill. He has testified before the U.S. Senate and House of Representatives, as well as the Equal Employment Opportunity Commission. His testimony in July 2011 before the U.S. House Education and the Workforce Committee highlighted the need to eliminate rulemaking changes that would shorten the National Labor Relations Board election period. Mr. Lotito has provided input on several other proposed regulations, including those to amend the Labor Management Reporting and Disclosure Act (LMRDA), by drafting amicus briefs and submitting extensive comments to federal agencies on behalf of various trade associations.
Mr. Lotito is also a foremost authority on, among other employment statutes, the Americans with Disabilities Act (ADA). As chairman of the Society for Human Resources Management’s (SHRM) National Legislative Affairs Committee, Michael was involved with the passage of the ADA and its implementing regulations. He has co-authored four books and several articles on the ADA. Mr. Lotito’s other published works provide insight on such topics as the Employee Free Choice Act (EFCA), global labor relations strategies, and workplace privacy.
Mr. Lotito earned both his B.S. and J.D. from Villanova University. He is admitted to practice in California.
