Piecing It All Together: The Amendment to the Federal Trademark Counterfeiting Act Prevents Circumvention Through Component Parts

AIPLA Quarterly Journal

In this Littler attorney-authored article, Philadelphia's Tiffani L. McDonough explains how the 2006 amendment to the Federal Trade Counterfeiting Act denies counterfeiters the ability to circumvent the Act. Circumvention was achieved in the past through a commonly used loophole which enabled the unscathed trafficking of counterfeit goods. McDonough also discusses how the sales of these goods threaten the economy, fund criminal organizations and may cause direct harm to consumers.
