The laws on electronic discovery continue to evolve in the wake of new e-discovery rules implemented by the federal government. While these rules have been established to ensure appropriate discovery requests, they have also drastically inflated litigation costs for defendants. Companies are now required to search through backup files or other electronic documents for materials that are specifically requested by the other party during discovery. "During employment discrimination lawsuits, for example, the plaintiff's attorneys would often demand all of the company's e-mail and documents involving their client, and defense attorneys had little recourse before the new rules were in place," stated James Ferber.
