3rd Circ. Lowers Bar For SOX Whistleblowers In Tyco Case

This article details the Third Circuit’s review of the whistleblower claim brought against Tyco Electronics Corporation. The appeals court decision stated that the whistleblower only needs a “reasonable belief” that their employer has violated or will violate the law in order to enforce a claim. Littler’s Gregory Keating says this ruling is an expansion of the first element of a Sarbanes-Oxley case and the ruling will increase the rapidly rising trend of whistleblower litigation.
