Littler’s Peter Susser and Peter Petesch Author New Publication on Disability Discrimination and the Workplace Released by Bloomberg BNA

WASHINGTON, D.C. (January 12, 2011) - Peter Susser and Peter Petesch, shareholders in the Washington, D.C. office of Littler Mendelson, P.C. (Littler), the nation’s largest employment and labor law firm representing management, have authored the second edition of Disability Discrimination and the Workplace for Bloomberg BNA, a wholly owned subsidiary of Bloomberg. The recently-released publication provides a comprehensive picture of the disability discrimination landscape and covers both pre-ADA Amendments Act (ADAAA) and post-ADAAA interpretations of the law.

“Now that the Equal Employment Opportunity Commission has issued its final regulations on the ADAAA and continues to issue other updated guidance, disability law is entering a new era of enforcement,” said Susser. “The increased coverage provisions have a profound effect not only on how disability cases are litigated and how the courts decide in these cases, but also on how management and employees interact prior to the filing of a lawsuit.”

 “With a much broader range of conditions that are now covered, the increased focus in the workplace is on the avoidance of discrimination on the basis of disabilities, accommodating employees with disabilities and on the protection of privacy,” added Petesch.

Disability Discrimination and the Workplace, Second Edition addresses the many questions that arise from the final regulations and also discusses:

  • The parameters of the Rehabilitation Act, with its development of similar key definitions, and the scope of the critical obligation to accommodate protected individuals;
  • The proliferation of state disability discrimination protections, some of which preceded the ADA and others of which were structured to coordinate with the ADA, and how these state measures are interpreted;
  • Public accommodation under Title III of the ADA, and new Justice Department regulations governing public accommodations; and
  • The intersection of disability discrimination law and other federal statues, including: the Family and Medical Leave Act, the Genetic Information Nondiscrimination Act, the Employee Retirement Income Security Act and the National Labor Relations Act.

The book also focuses on issues that likely will define disability discrimination litigation in the coming years.
