Incentive plans, including commission, bonus, piece rate and other types of plans that reward accomplishment, must evolve to meet the constraints of new court decisions and to keep pace with the refinement of the enduring concepts which underlie such plans. Because incentive plans typically establish common terms of employment for many employees, they are an increasing target of class actions.
