In June, the Pennsylvania Department of Labor and Industry released proposed regulations that would significantly change overtime exemption eligibility rules for Pennsylvania employees. The proposal would raise the required salary threshold for "exempt" status to more than double the current rate set by the federal government, with automatic increases every three years thereafter. Also, while the proposal was intended to align the "duties" tests for the administrative, executive and professional exemptions with their federal counterparts, the proposal falls far short of that objective, leaving considerable uncertainty for Pennsylvania employers about whether their employees are properly classified as exempt.

The public will have until August 22, 2018, to submit written comments in support of or in opposition to the proposed regulations.
