"DOL Opinion Letter: Timekeeping Policy Complied with FLSA," Society for Human Resource Management (SHRM)
The Department of Labor (DOL) has provided employers with an opinion letter which states that the Fair Labor Standards Act (FLSA) regulations do not specify any particular method of recording compensable time, and only requires that the relevant information be maintained and preserved. Julie Dunne of Littler's San Diego office said the opinion letter provides clarity but noted that there are very reliable technological options. "HHCs (hand-held computers) might be set up to prompt the employees to take required meal and rest breaks and not let them clock back in until their required breaks are over," said Dunne.
