Managing employees with medical conditions can often trap employers in a complicated legal web that involves the intersection of the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), Workers' Compensation, and state disability and leave laws. The new FMLA regulations effective January 16 and recent amendments granting FMLA rights to families of persons serving in the military will expand who is eligible for leave and for how long. The latest amendments to the ADA, which go into effect in January 2009 will also expand who is considered disabled and affect with whom employers must engage in the interactive process.
