A Survival Guide for Employers
Recent Massachusetts legislation expands protections to employees and job applicants, while creating new challenges for employers. The most publicized change is the "ban the box" legislation, which effective November 4, 2010, prohibits most employers from inquiring about criminal history on initial employment applications. The amendment to the Massachusetts Personnel Records Statute, which was effective August 5, 2010, imposes burdensome notice requirements on employers. Finally, the Massachusetts Data Security Regulations that went into effect January 1, 2010, require employers to adopt workplace privacy and access management policies.
