James M. Gilbert is Special Counsel on the Class Action Counsel team and is based in Illinois. As a brief writer assigned to class, collective, mass, and PAGA actions, Jim formulates and executes briefing strategy. He evaluates and selects legal authority that supports the facts and circumstances of each case and prepares substantive briefs and motions, including complex dispositive motions, opposition to class certification, motions to compel arbitration, mediation briefs, and other strategic briefing.
Prior to joining Littler, Jim spent more than 22 years exclusively litigating employment cases in California - primarily wage and hour cases - at the trial, appellate, and administrative hearing level. Jim joined Littler in 2022 to focus on brief writing for class action and PAGA cases and brings his vast practical, hands-on experience to the drafting of highly sophisticated legal and factual arguments present in California class and PAGA litigation. In total, Jim has been involved in the litigation of over 300 California wage and hour cases and arbitrations.
