In this morning radio talk show, Littler's Tim McInturf explains the importance of the recent Sheshunoff case, which has clarified the landscape of non-compete agreements in Texas. McInturf explains confusion of non-compete agreements in Texas over the last two decades. "The main problem in non-compete law in Texas for the last 20 years," says McInturf, "is that legislation in the 80's became more conservative and tried to make it easier to enforce non-compete agreements, and the court system was hostile to non-compete agreement and would strike them down, even though legislature had outlined what they need to be enforceable." McInturf also describes the parameters of this change in the Texas legal landscape, and how it affects employers and their intellectual property. "It's important to business people in the state," he says, "and we need certainty in this area of the law."
