The Interplay of the FMLA, ADA and Workers’ Compensation Laws

Tuesday, September 16

  • 7:00 AM PDT
McLean, VA

Managing employee leaves of absence requires employers to navigate a complex and ever-changing maze of employment laws – including the ADA and FMLA at the federal level, state workers' compensation and additional laws at the state level. With the increase in government enforcement action and employee discrimination and retaliation claims, the complexity of managing leaves and the associated legal risks continue to grow.

In this complimentary program, we will examine important recent developments under the ADA and FMLA and local state leave laws, and will provide practical guidelines for effectively managing some of the most common and frustrating leave challenges, including:

  • Determining leave eligibility
  • Managing intermittent and reduced-schedule leaves
  • Providing benefits during leave
  • Reinstating employees after leave
  • Terminating employees during or after leave
  • Managing military leaves
  • Determining eligibility for workers’ compensation wage loss indemnity benefits
  • Coordinating employer-funded disability plans with workers’ compensation entitlement
