Tackling the Intersection Between and Among the ADA, the FMLA, and Collective Bargaining Agreements

A common issue facing many unionized employers is how to reconcile the ADA, the FMLA, and collective bargaining agreements when handling leave and accommodation requests from bargaining unit employees. This presentation will review the intersection between and among the ADA, the FMLA, and collective bargaining agreements, with a specific focus on addressing common exposure areas and pitfalls. We will also analyze how employers may approach situations in which a collective bargaining agreement conflicts with the requirements of the ADA and the FMLA and the importance of avoiding such conflicts when drafting bargaining proposals. Finally, we will end the program with several useful takeaways and practice pointers that employers may wish to keep in mind when grappling with these issues.
