Can you ask an employee to disclose the username and password for his or her social media account in order to look at what s/he may have posted about your company? Can you ask the employee’s “friend” to log on for you? Do you need to take any precautions before asking about an applicant’s credit history prior to hire? Is there a legally-complaint way to ask about gaps in an applicant’s work history? Can you receive and store personal information regarding E.U. employees here in the U.S.? Can you ask an employee who is on prescription medication to identify what drugs he or she is taking?

Is ignorance bliss? Or are the forewarned really forearmed?

Explore whether “frequently-asked” or “want-to-ask” questions in the employment context can or should be asked. This session will be interactive, so come with your questions in hand. Attendees will leave with a greater understanding of modern workplace privacy concerns and related obligations under federal and state laws.
