New Developments in California Prevailing Wage Law for 2017

In recent years, new and increasingly complex requirements under California's Prevailing Wage Law (PWL) have been heaped upon construction contractors and developers who perform work on public works projects, with no letup in sight. Experienced contractors know that compliance with the PWL presents a daunting task. The unclear and often clashing prevailing wage obligations imposed on public works contracts make compliance difficult and fraught with legal risk. These obligations, along with ever-changing legislation and fluctuating administrative interpretation and enforcement, mean even minor errors can turn a potentially profitable project into a disaster.

California's state and local lawmakers have enacted a wave of new prevailing wage legislation that takes effect in 2017 that directly impacts contractors and developers of public work projects, with more legislation in the pipeline. Our presenters will discuss the past year's legislative and administrative developments, and offer preventive measures and practical suggestions for complying with California's ever changing PWL. The topics will include:

  • New and pending legislation amending the PWL
  • New apprenticeship requirements
  • Recent trends and compliance conundrums
  • The death of the Charter City exemption and the new UC policy
  • The expansion of prevailing wage requirements beyond public works
  • The challenges posed by Labor Management Cooperation Committees
  • Project and contractor registration and electronic submission of certified payroll records
  • Important preventive measures and practical recommendations.

The goal is for you to leave this 2-hour session with a greater understanding of the requirements of the California PWL, when and how it applies, what the requirements are and how to ensure compliance, precautions to avoid problems, and the proactive strategies and tactics to help keep your business out of trouble where the precautions fail.
