This presentation will focus on the significant reversals by the NLRB and other developments over the past 24 months, during which the Trump Board has reversed, narrowed or redefined many of the prior Obama Board decisions that overturned many years of precedent. The presenters will discuss the change in Agency's direction spearheaded by the NLRB's General Counsel, changes in precedent that are likely to have the most significant impact on both nonunion and union employers and the prospects for future change. Including:

  • Issues in the crosshairs of the NLRB's new General Counsel
  • End of the Obama Board's war on handbooks and policies - now what's legal and what's not
  • Use of employer email systems
  • Joint employer standard revisited
  • Confidentiality of investigations
  • Class action waivers
  • Union organizing - end of “micro units"
  • What's on the horizon

This update will provide attendees with an understanding of the law governing the workplace in the context of employer rules, regulations and practices as they affect employees' rights under federal labor law.
