Workers in the U.S. and around the globe are on the move, taking advantage of the opportunity to “wander” and work temporarily from a variety of remote locations due to the COVID-19 pandemic and the new general rule of working from home. Many workers leave their existing homes and work from foreign locations - sometimes without the knowledge or approval of their employers, who may not even keep track of workers’ locations. As most employment, social security and payroll law requirements are based on the geographic location of the worker, this new normal of employees working from other countries triggers unexpected compliance issues that employers must appreciate and address.

A panel of Littler attorneys will present a lively discussion of the “international wandering worker” challenge, including:

  • Defining the international wandering worker and distinguishing them from business visitors and expatriate employees
  • Hidden potential risks and liabilities for multinational employers who allow their employees to be international wandering workers, such as:
    • Corporate tax, payroll tax and social security risks
    • Application of local employment laws
    • Noncompliance with rapidly emerging local work-from-home regulations
    • Potential employer liability for unforeseen events/circumstances
  • Tips for embracing flexibility while reducing employer compliance and liability risks
