ERISA Compliance in 2018: Changes, Observations and Current Issues

With increased Internal Revenue Service and Department of Labor audit activity and class action lawsuits on the rise, vigilant administrative and fiduciary oversight of employee benefit plans is critical. Employers must be cognizant of the exposure that arises from sponsoring retirement and health and welfare plans for their employees. In this session we will discuss the basic steps employers can take to maximize the value of the benefits they are providing to employees and, at the same time, limit their liability. This program is specifically crafted to aid in-house counsel and benefits professionals in this quest.

Specifically, we will discuss:

  • Simple document drafting tips which reduce legal exposure
  • Improving plan administrative practices
  • Best practices in fiduciary governance, including selection and monitoring of plan investments, the importance of plan committee charters and investment policy statements, and training plan committee members and running a committee meeting
