Companies have come to believe that the answer is always “no” whenever the ADA or FMLA is involved. Employers are so often told what they cannot do, it is easy to lose sight of everything they can do. Our Texas lawyers will identify actions that employers can take under the ADA and FMLA in a variety of common situations. Many of these actions are “reverse-engineered” from existing, but little-known, case law. Join us for an informative and practical discussion covering the application of FMLA and ADA, pushing back on certification problems, the appropriateness of medical exams or testing, dealing with requests for reasonable accommodation, and terminating employment in the face of FMLA and ADA issues.
