Effective internal investigations are one of the most critical components in the area of employment law liability prevention. Employee lawsuits are increasingly focusing on the adequacy of an organization's investigation, with verdicts turning on whether the investigation was properly conducted and if the investigator was sufficiently trained. Internally, effective investigation practices have become a large part of an employer's ability to promote and maintain a “speak-up" culture, wherein employees learn to associate their organization's responsiveness to complaints with important principles of fairness and respect. In our current environment, we have to ensure our virtual investigations met our entities' and employees' needs and expectations.

Our innovative and sought after Littler approach to proper investigations training includes the opportunity for participants to integrate the experience through real world examples.

Course Objectives:

• Identify and follow the stages of an investigation and the role of the investigator throughout
• Determine the objective characterization of allegations and the scope of the investigation
• Understand the investigator's role in gathering facts and evaluating evidence
• Conducting interviews that encourage participation, get to the facts, and demonstrate the company's dedication to the process whether the investigation is conducted in-person or virtually
• Learn to balance the need to get the facts, give the accused a fair opportunity to respond, and ensure confidentiality
• Respond to and evaluate common challenges, or “curveballs”, that may arise in investigations, especially in the virtual context
