2020 Voluntary Retirement and Exit Incentive Programs: A Viable Alternative to Involuntary Layoffs

During this time of uncertainty, many companies are looking for alternatives to involuntary layoffs. A program that offers incentives to employees to voluntarily terminate employment has many advantages that employers should consider. These include programs that offer senior workers incentives to retire (Early Retirement Programs) or offer a more general group of employees incentives to resign in exchange for severance (Exit Incentive Programs). This webinar will address:

  • Legal issues associated with such plans, particularly under the ADEA, OWBPA, WARN, and ERISA
  • How to decide the types of groups to which these programs can be offered, such as age only, age plus years of service, particular groups within the organization, and locations
  • Common incentives offered
  • Timing and administration
  • Communications to employees
  • Managing applicants and reserving the right to reject applicants
  • Providing for transition periods
  • Securing effective releases
  • Coordinating with possible involuntary reductions in force
  • Common challenges to early retirement and exit incentive programs
