Perez Nomination Raises Ethical Quandary for Looming Labor Rule Set to Invade Business

Littler’s Michael Lotito authored an article on how the nomination of Thomas Perez, who has been charged with some ethically questionable behavior, to be secretary of state raises ethical issues for the imminent final “persuader” regulations. The rule may put attorneys in a position to choose between complying with the Department of Labor’s (DOL) expanded reporting requirements, thereby violating client confidentiality, or facing criminal sanctions.
