How companies should deal with marijuana legalization

In an article on state laws on recreational use of marijuana, Littler’s Nancy Delogu provides commentary on the potential impact on employers. She notes that previous court decisions involving medical marijuana use by employees suggest that an employer does not have to accommodate recreational users, but that four states have laws requiring such accommodation, all of which have yet to be tested in court. Delogu also provided recommendations for revising the wording of drug policies and discussed how the new legislation might affect the enforcement efforts of the Department of Justice.
