Managing employee accommodation requests is among the most difficult for any HR professional and in-house counsel. The job is even more challenging now, as the recently enacted Pregnant Workers Fairness Act (PWFA) requires employers to provide reasonable accommodations due to an employee's limitations associated with pregnancy, childbirth or related medical conditions. This presentation will tackle the most common and difficult pregnancy accommodation scenarios that employers face and provide practical suggestions on how employers can address these situations.

The presenters will address the following:

  • Is the PWFA just another version of the ADA? How are they different?
  • How broad is the PWFA? Does it cover in vitro fertilization and related conditions and treatments outside of pregnancy?
  • How do I communicate with an employee when they request a pregnancy accommodation?
  • When can we place an employee on a leave of absence instead of providing an on-the-job accommodation?
  • When can an employer seek medical documentation to support the need for an accommodation?
  • For how long is a pregnancy accommodation reasonable and required?
