As a member of the Littler CaseSmart® team and based in Arkansas, Delena Choong Hurst is responsible for handling administrative agency charges from investigation to conclusion. She works on client-dedicated service teams, focused on handling charges. She investigates charge allegations, reviews pertinent documents, interviews key witnesses, and provides clients an assessment of the risks associated with the charge. In partnership with the client, Delena defends the charge by drafting persuasive position statements and responses to the agency’s requests for information and/or pursues resolution of the charge through formal or informal settlement negotiations.
Previously, Delena represented clients in all labor and employment matters arising under state and federal laws. She appeared in state and district courts and before the Equal Employment Opportunity Commission (EEOC) and the Arkansas State Claims Commission. She has experience with claims arising under:
- Title VII of the Civil Rights Act of 1964
- The Fair Labor Standards Act (FLSA)
- The Family and Medical Leave Act (FMLA)
- The Americans with Disabilities Act (ADA)
- The Age Discrimination in Employment Act (ADEA)
- Arkansas Civil Rights Act
- Arkansas Whistleblower Act
Delena has advised clients about employment policies and conducted training sessions regarding the FMLA, the ADA, and the FLSA. She has also trained supervisors and executives on best practices in the workplace. Prior to joining Littler, Delena was the associate general counsel for the Arkansas State University System.
