Key Statistics, Regulatory Update, Report Card on the EEOC’s Strategic Enforcement Plan and Littler’s Top Ten List of What to Watch for in FY 2015

On December 3, 2014, the Senate approved the nominations of David Lopez to serve a second term as EEOC General Counsel, and Charlotte Burrows, a Department of Justice Associate Deputy Attorney General and former staffer for the late Sen. Ted Kennedy, to serve a five-year term as EEOC Commissioner. The Commission is now a full five-member panel with a Democratic majority. Based on these confirmations, the EEOC is well-positioned to continue to aggressively pursue its Strategic Enforcement Plan adopted in December 2012.

This webinar will review various highlights from Littler’s Annual Report on EEOC Developments - Fiscal Year 2014, which provides a comprehensive overview of the significant cases, regulatory developments and other activities involving the EEOC.

This session will review key EEOC developments in FY 2014 and what to anticipate in FY 2015. Topics to be covered include:

  • Key statistics, including review of data involving systemic investigations and related litigation
  • Review of EEOC’s success and major losses in FY 2014
  • Littler’s top ten list of what to watch for in FY 2015
  • The view from Washington and noteworthy regulatory developments
  • An update on procedural developments, including the status of Mach Mining and its potential impact on the conciliation process
  • A “report card” on the EEOC’s efforts in its Strategic Enforcement Plan, including an update on key cases involving:
    • Barriers in recruitment and hiring
    • Protecting vulnerable workers
    • Emerging issues, including pregnancy discrimination, religious accommodation, reasonable accommodation and other significant challenges under the ADA, and evolving LGBT rights under Title VII
    • Enforcing equal pay laws
    • Preserving access to EEOC processes
    • Preventing harassment on the basis of sex, race and other forms of harassment through systemic enforcement
  • Final takeaways for EEOC compliance in 2015
